These Terms of Service ("Terms") govern your use of our website at americocollision.com and the collision repair services provided by Americo Collision ("we," "our," or "us"), located at 6113 Milwee St, Houston, TX 77092. By accessing our website or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our website or services.
1. Acceptance of Terms
By accessing our website, requesting an estimate, or authorizing repairs on your vehicle, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. We reserve the right to modify these Terms at any time. Changes become effective immediately upon posting to our website. Your continued use of our website or services after any modifications constitutes your acceptance of the updated Terms.
2. Description of Services
Americo Collision provides professional collision repair and auto body services, including but not limited to:
- Collision repair and structural restoration
- Auto body and paint refinishing
- Paintless dent removal (PDR)
- Frame straightening and alignment
- Windshield and auto glass replacement
- Insurance claims assistance and coordination
- Vehicle damage assessments and estimates
The specific scope of work for each repair is determined on a case-by-case basis and will be outlined in a written estimate or repair order authorized by the vehicle owner or their designated representative.
3. Estimates and Pricing
All estimates provided by Americo Collision are based on a visual inspection and/or documented damage assessment at the time of evaluation. Estimates are subject to the following conditions:
- Supplemental Damage: During the repair process, additional damage may be discovered that was not visible during the initial inspection (often referred to as "hidden" or "supplemental" damage). If additional repairs are necessary, we will notify you and, if applicable, your insurance company before proceeding with the additional work. Supplemental charges may apply.
- Estimate Validity: Estimates are valid for 30 days from the date of issuance unless otherwise stated. Parts pricing and availability are subject to change.
- Authorization: No repair work will begin until you or your authorized representative has provided written or verbal authorization. For insurance-covered repairs, authorization from the insurance adjuster may also be required.
- Payment: Payment is due upon completion of repairs and before vehicle release. We accept cash, checks, credit cards, and insurance payments. You are responsible for any deductibles, co-payments, or amounts not covered by your insurance policy.
4. Vehicle Storage and Abandonment
If your vehicle is left at our facility, the following terms apply:
- Vehicles awaiting repair authorization or parts may be stored at our facility. Storage fees may apply after a grace period of five (5) business days from the date we notify you that your vehicle is ready for pickup or that authorization is needed.
- If a vehicle is not claimed within thirty (30) days of completed repairs or within thirty (30) days of our request for repair authorization, the vehicle may be considered abandoned under Texas Transportation Code Chapter 683, and we may pursue applicable legal remedies, including filing for a mechanic's lien.
5. Warranty
Americo Collision stands behind the quality of our workmanship. Our warranty terms are as follows:
- Workmanship Warranty: We provide a limited lifetime warranty on all collision repair workmanship performed by our technicians, covering defects in repair quality such as paint adhesion, color match, and structural repairs, for as long as you own the vehicle.
- Parts Warranty: Parts used in repairs carry the manufacturer's original warranty. OEM (Original Equipment Manufacturer) parts are covered by the vehicle manufacturer's warranty terms. Aftermarket parts carry the aftermarket supplier's warranty.
- Exclusions: Our warranty does not cover damage caused by subsequent accidents, misuse, neglect, normal wear and tear, environmental factors (hail, flooding, UV exposure), unauthorized modifications, or repairs performed by third parties after our work is completed.
- Warranty Claims: To make a warranty claim, contact us at (281) 906-7696 or bring your vehicle to our shop for inspection. We will assess the issue and, if covered under warranty, perform the necessary corrections at no additional charge.
6. Insurance Claims
Americo Collision works with all major insurance companies to streamline the claims process for our customers. However, please note:
- We are not an agent or representative of any insurance company. Our role is to assist you in the repair process and communicate with your insurer regarding the scope and cost of repairs.
- You, as the vehicle owner, are ultimately responsible for the cost of repairs. If your insurance company disputes, denies, or underpays a claim, you remain liable for the balance owed.
- We will make reasonable efforts to negotiate with your insurance company on your behalf, but we cannot guarantee any specific outcome regarding claim approvals or payment amounts.
- Any deductible or out-of-pocket amount specified by your insurance policy is your responsibility and is due at the time of vehicle pickup.
7. Limitation of Liability
To the fullest extent permitted by applicable law:
- Americo Collision's total liability for any claim arising from our services shall not exceed the total amount you paid for the specific repair giving rise to the claim.
- We shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of use, loss of revenue, loss of personal property left inside vehicles, or diminished vehicle value.
- We are not liable for delays in repair completion caused by factors beyond our reasonable control, including but not limited to parts availability, insurance processing delays, supply chain disruptions, or acts of nature.
- Customers are advised to remove all personal belongings from their vehicles before leaving them for repair. Americo Collision is not responsible for personal items left in vehicles during the repair process.
8. Intellectual Property
All content on the Americo Collision website, including but not limited to text, graphics, logos, images, and software, is the property of Americo Collision and is protected by United States copyright and trademark laws. You may not reproduce, distribute, modify, or create derivative works from any content on our website without our prior written consent.
9. Website Use
When using our website, you agree not to:
- Use the website for any unlawful purpose
- Submit false or misleading information through our forms
- Attempt to interfere with the website's operation or security
- Scrape, crawl, or use automated tools to extract content from our website without permission
- Upload or transmit malicious code, viruses, or harmful materials
10. Indemnification
You agree to indemnify, defend, and hold harmless Americo Collision, its owners, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or relating to your breach of these Terms, your use of our services, or your violation of any applicable law or regulation.
11. Dispute Resolution
In the event of any dispute arising from or relating to these Terms or our services, the parties agree to first attempt to resolve the matter through good-faith negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue resolution through mediation or binding arbitration in Harris County, Texas, in accordance with the rules of the American Arbitration Association.
12. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Harris County, Texas, and you hereby consent to the personal jurisdiction and venue of such courts.
13. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.
